    More than 1,000 registered nurses at Kaiser Permanente facilities in California are owed back wages after an arbitrator ruled that the health system must repay pay lost after a payroll system change it made in early 2021, according to the California Nurses Association (CNA). The union announced the decision on Monday, Oct. 5, 2026.

    The union estimates the total owed could reach tens of millions of dollars. That figure comes from the union alone. Kaiser has not released its own estimate, and the arbitrator’s written decision has not been made public, so the exact amount each nurse will receive and the repayment timeline remain unknown.

    For the nurses involved, the ruling closes a dispute the union says took years to document. For patients, it comes in the middle of contract talks in which hospital staffing is a central issue.


    A Payroll Switch, Years of Underpayment and a Ruling Not Yet Public

    According to the union’s news release, the problem began when Kaiser changed its payroll system in early 2021. Nurses were underpaid as a result, and the union said it took years to fully document the problem because it had no direct access to Kaiser’s payroll records.

    «They changed their payroll system, messed it up, and let the mistake steal millions of dollars from nurses,» CNA President Michelle Gutierrez Vo, an adult and family medicine nurse at Kaiser Fremont Medical Center, said in the union’s statement.

    KQED reported that a December 2024 Kaiser payroll audit found 1,142 nurses had been underpaid and 1,813 overpaid, and that Kaiser did not try to recover the overpayments. One affected group was Staff Nurse IIs in Northern California, and Kaiser said it took steps to place affected employees in the appropriate salary bracket. It remains unclear how much each nurse will get, and Kaiser declined to disclose details of the payroll error.

    The case went through arbitration, the dispute process written into the nurses’ union contract, rather than a courtroom.


    Kaiser Says It Will Pay and Contact Every Affected Nurse

    In a statement to KQED, the company said it disagrees with the union’s characterization of the dispute but will honor its obligations under the arbitrator’s decision. «We will reach out directly to every affected nurse promptly,» a Kaiser spokesperson said.

    A company spokesperson told Becker’s Hospital Review, «It was important that this dispute be addressed through the process outlined in our collective bargaining agreement.» Kaiser added that it is «committed to ensuring every one of them is paid accurately and in full accordance with their contract.»

    Kaiser also told KQED that its nurses are among the best paid in the industry. According to the company, a Staff Nurse II in Northern California often earns more than $100 per hour before overtime and premium pay, which Kaiser said is about 7% above market for similar roles at other health systems. Those figures are Kaiser’s own and were not independently verified.

    The two sides agree that affected nurses will be repaid but disagree on how to describe the problem. The union calls it wage theft, a term that implies intent, while Kaiser describes a payroll accuracy issue that it is correcting. No finding of intentional wrongdoing has been made public.


    Contract Talks, Staffing Complaints and the Patient Connection

    The ruling comes during negotiations between Kaiser and the CNA, which says it represents more than 25,000 nurses at 22 Kaiser facilities in California; KQED has put the number at about 23,000. KQED reported in September that the previous agreement expired at the end of August and that, after nearly a dozen bargaining sessions, the two sides had not yet discussed wages.

    The union has made staffing a top demand. On Sept. 1, nurses held informational pickets at 22 Kaiser facilities from Sacramento and the Bay Area to Fresno, calling for safe staffing on every shift and protection against untested artificial intelligence in patient care. In Oakland, pediatric nurse Craig Cedotal told KQED that procedure nurses had filed about 5,000 forms objecting to assignments they considered unsafe.

    Kaiser has disputed that picture. The company told KQED it staffs at state-mandated nurse-to-patient ratios using a system it developed with the CNA, and that technology supports nurses rather than replacing them.

    None of the sources reviewed show that the underpayments affected staffing levels or patient outcomes. Pay accuracy and staffing are both live issues in the same contract fight, and how those talks end will shape working conditions for the nurses who staff Kaiser’s emergency rooms, labor units and medical floors.

    No strike has been announced over this ruling. Patients with appointments or procedures scheduled at Kaiser facilities should continue with their care plans and contact their care team directly with any scheduling questions.

    Nurses who worked at Kaiser’s California facilities since 2021 and believe they may have been affected should keep their pay stubs and timesheets, watch for direct contact from Kaiser, and check with their union representative about how claims are being calculated. Kaiser has not said when payments will go out or how they will be calculated.
